tax return - contract not honored

We filed with H&R Block, received a next day rapid refund. The day after, discovered the preparer did not include our four children (a six thousand dollar difference). we had to wait three weeks to file the 1040x which takes 8 - 12 weeks to process. In the 7th week the IRS says we now need to submit a form 8812 to verify the child tax credit. Needless to say we are in financial turmoil. We did not sign up for the protection plan, which doesn't cover rapid refunds anyway. What recourse do we have? Can we sue H&R Block for not delivering a service correctly or in the time fram paid for? (two day turn-around)

Sure, you can sue them. You may even find you are one of many people who got hurt by this service provider and become part of a class action suit.

First, I would suggest you contact their corporate headquarters first and ask that they refund your fee, pay for any other expenses you are out because of the debaucle, and interest of around 18% compounded daily for each day you are delayed in the return. Be ready to settle for less than you ask for.
