I'm not sure I am following your whole story - you say the computer was 'apparently' new, and then a replacement harddrive appeared used, but it was not the correct replacent harddrive anyway - is that correct? You left out many facts (or confused the facts).

All you really want is what you paid for, right? A working computer equal to the price you paid? Or a refund if Staples can't/won't make it right? So, what you do first is communicate with customer service until they make it right. Put complaints in WRITING, sent certified mail return receipt requested. READ your purchase agreement, service agreement, and warranty agreement to know your rights and responsibilities.

If you exhaust your options, and it still has not been made right, then you can pursue a lawsuit in order to be made whole (not more than that, though). You would follow the rules of Kentucky law (probably in small claims) and/or hire a Kentucky attorney to assist you.
