Legal Question in Construction Law in Kentucky
Contruction/Contract law
Built a new home and hired a company to install a geo-thermal heating and air contioning system. The firm didn't level the condensation pan that the unit sits on in the attic and didn't blow out the dust and debri from the lines before turning it on while we were out of town. The lines back up with water and leaked over the pan and water came through the bathroom ceiling and an interior wall into the electrical out lets. The company said they would take care of it.They sent a drywaller out who stuck a knife in the wall and said yep, its dry and patched the drywall. Then sent a bill for the remaining balance the next day. After speaking with an environmentalist regarding mold, he stated that everything that got wet should be removed (insulation, drywall ect., therefore, I have refused to pay them until this is done. The water had to pool in the attic quiet a long time before coming through the ceiling as it is covered in green/blue board. We collected 5 gallons ourselves when finind it. The company says that I owe them the money and put a lean on our home and says that the water damage is another issue and has nothing to do with what I owe them according to ky contract law.

I am afraid you have passed the point where self-help is going to be a wise approach to this problem. You are going to need legal assistance on this.
