Legal Question in Consumer Law in Kentucky
We boarded our dog while on vacation at a kennel, the dog got out and was hit and killed by a car. Do we have a case or be entitled to some restitution?
1 Answer from Attorneys
Possibly. You need to consult with an attorney about this matter. Generally when a person leaves a pet with a kennel a "bailment" is created that requires the organization accepting your property (the dog) to use reasonable care in taking care of your property (the dog). Allowing your dog to get out and be hit by a car should not be considered reasonable care, but the circumstances surrounding your dog getting out may be used as a defense by the kennel. Also, an attorney needs to review any contract you signed when you left your dog with the kennel as the kennel can avoid or limit the damages available through contractual language. Finally, your damages would depend on the age, health and type of dog. Again, you should consult with an attorney about this matter.
