foreclosure

my husband lost his job in february. we have been trying to surrender our home (which we moved out of on 3/3) to the mortgage company. they now say we do not qualify for to surrender deed in lieu of foreclosure and have filed foreclosure papers on us. we need to know what our rights are and how to protect our few remaining assets.

You need to consult with an experienced bankruptcy lawyer. The fact that the lender foreclosing on your mortgage says that you "do not qualify" for a deed in lieu likely means either that they think they can recover any deficiency balance from you OR there are other mortgages or liens on the property. In either situation, you should seek a free bankruptcy evaluation from a qualified attorney.
