Legal Question in Credit and Debt Law in Kentucky
intentional twisting of the facts
A collection company notified me that I had debt from a ex wife that I have been devorced from for 9-10 years. She died in a hospital 9 months ago leaving alot of bills. My daughter called them from my house without me knowing and told them she had passed away. Shortly after they began harassing me. I guess now between caller ID and my daughter's call they thought they could extort money from me. The last straw was when they sent all files in the mail to me demanding money now or a lawsuit with where I worked/everthing.I called them they laughed and ask me if I was going to pay or argue. So I started calling everyone on that list telling them I was going to contact a lawyer over them wrongly attacting me. Come to find out my name was not on any of their files and all of their files showed her as divorced and not living at my address. All 7 creditors started calling the collection company demanding they stop. They sent me a letter saying they where sorry and removed those in question from my name. Now I have to fix my credit reports. they told me to dispute those they would not argue. last night I received a letter from my BOSS at work that was addressed to me from them. I work in a casino and handle alot of money SAD.lawyerornot

Re: intentional twisting of the facts
Depending on the facts, you may have legal claims against these creditors under the Fair Debt Collection Act. You may wish to consult an attorney. If you would like to meet with me, please do not hesitate to call.
Re: intentional twisting of the facts
It sounds as if you may have a claim against the collection agency for violating the federal Fair Debt Collections Practices Act and potentially other statutes as well. Contact a lawyer who handles consumer cases and get an appointment to have your case properly evaluated.
