Legal Question in Credit and Debt Law in Kentucky

Leins

I got a judgement against an individual.....I put a lein on a property he has locally.

The property was auctioned off .....and the motgage Co ''bought it'' and now how do I collect my money ???

They cannot get a free & clear title on the property since I have a lein on it ??

Re: Liens

It sounds as if the property was foreclosed upon by the

first mortgage holder. It was sold by the court and the

highest bidder was the mortgage company. The sale

extinguished all liens. It is not unusual for a foreclosure

sale not to bring enough money to pay off all the liens on

a piece of property.

You can still try to collect on your judgment, though. For

example, you could cause garnishments to be issued to local

banks; if the judgment defendant has an account there (and you

have properly and adequately identified him), you could receive

the money in the account.
