Medical Bills

I recieved a letter in regards to going to court being sued by an hospital. What does it mean when it says ''Notice to dismiss for lack of prosecution'' ang ''...why the action listed herein should not be dismissed at the cost of the plantoiff for the reason that no pretrial step has been taken in the past year.'' Does this mean I heve to go??

Based on your post, it appears that you were sued a year or more

ago concerning a medical bill. Then the lawyer for the hospital

did nothing to resolve the suit -- at least nothing the court

could see. As a result, the court is invoking Civil Rule 77.02, which

allows the court to dismiss actions which are not being followed up

on by the party who brought it.

If the hospital takes some action -- asks for a trial date, whatever -- the

court will likely allow the case to stay on the docket.
