How long after an assault can you file an arrest warrant against your attacker?

It is not possible to give you a clear legal answer to your inquiry without a more detailed evaluation of the facts of your case. Several questions are presented:

1. Were you seriously injured?

2. Was a deadly weapon or dangerous instrument used?

3. Are you or your assailant law enforcement officers?

Warrants for assaults involving serious injury or involving deadly weapons or dangerous instruments are generally considered felonies in Kentucky, and may be issued at any time. Less serious assaults are generally misdemeanors, and warrants must be issued within the one-year statute of limitation.

Assuming it's a misdemeanor assault charge, the charge must be brought within 12 months of the attack in the Commonwealth of Virginia.
