Legal Question in Criminal Law in Kentucky
Help
My brother was charged with Rape and has been held in a Kentucky jail since Aug 27 2000.He has not had a preliminary hearing.Every time a date is set for some reason it is always continued.Is there not some law that requires a hearing to be held within so many days? He is innocent and they do not have any evidence
to charge him with this crime.He had lived with this woman for approx.2 years.

unless waived, a preliminary hearing for one in jail must be held in 10 days or released.
