Legal Question in Criminal Law in Kentucky
Burglary
What makes the difference between 2nd and 3rd degree Burglary? I was under the impression 2nd degree was when someone was home in the residence and 3rd was when no one was home, is this correct?

2nd Degree Burglary covers "dwellings" while 3rd Degree Burglary covers "buildings" Dwellings are places where people live. Buildings are not necessarily residences/dwelling places (ie: office building, etc...) Good luck.
