Legal Question in Criminal Law in Kentucky

clearing my record

this is my first offense in shoplifting and my record is clean. do i have to hire an attorney to bring up a diversion program or ask for something to get it removed from my record or can i ask the judge personally? i am new at this and have never been to court so i need some advice on what to ask for.

You can represent yourself and ask the prosecutor for diversion, but such requests are usually more successful if made by a lawyer. Your lawyer is (or should be) trained to make the objective arguments in your favor to support having your case placed in the diversion program. It is hard to be objective about your own case -- that's why most lawyers get another lawyer to represent them if they have a case in court.

In your particular county, hiring a lawyer will likely also cut down on the amount of time you spend waiting in court. Your lawyer, if he or she practices regularly in that court, can speed the resolution of your case -- potentially saving you hours of waiting.
