Legal Question in Criminal Law in Kentucky
My crimes were diverted i, does this mean I was convicted?
While in college I recieved a citation for underage drinking and on another occasion I was arrested for urinating behind a bar. On the latter occasion I was charged with Public Intoxication and Indecent Exposure. The judge ''diverted'' all charges on both occasions in agreement that I do community service. My question is when asked if I have been convicted of a crime (on job applications) what should be my response? My assumption is that the diversion took place before the process of conviction took place and my answer should be ''no.''

In all likelihood, the cases were dismissed after you completed the "diversion period." To be safe, and sure, go to the courthouse in which your case was heard and pull the file from the clerk's office. If the file is in storage, ask for a docket sheet BEFORE you order the file, because the docket sheet may be able to tell you what you need to know and should be available instantly.
