how does someone get prosecuted for bad checks

In Kentucky, the holder of a bad check can go to the County Attorney's office to request prosecution. Ordinarily, the County Attorney will send a "10 Day Letter" to the person who wrote the check, giving them ten days to make the check good.
If the check is NOT made good within that time, the County Attorney may institute theft/bad check proceedings. There are exceptions, of course...
