Legal Question in Criminal Law in Kentucky
cultivation of marijuana
my boyfriend and i were arrested for cultivation of marijuana over 5 plants. it was growing on his property, in a vacant lot, we don't even use. I live on the residence but had no knowledge of the plants growing here. they arrested me and charged me with the same as him. there is no evidence linking me to the plants. why was I arrested too? Is there any chance the charges will be dropped on me?

Re: cultivation of marijuana
Hello,
It is common practice for police agencies to
"overcharge", which is, to charge persons who they have no chance of convicting, and to charge more crimes, and elements of crimes, than they will be able to prove. There are a lot of reasons for this, which I won't go into here. I suggest that you obtain the services of a criminal lawyer in your county or from a nearby county, preferably one who has some experience in drug cases. These charges are felonies, and are a very serious problem. If you are VERY poor, the public defender can be appointed in your case, and some of them can be very good. It is especially important not to try and "handle this yourself", many people in prisons have made that mistake. It will be expensive to get a good lawyer, but it is money well spent, a felony conviction is something that will haunt you for many many years. Do not talk to ANYONE except your own lawyer about this case, even friends/family. It is probably a good idea for you and your boyfriend to have different lawyers. Good Luck.
