Legal Question in Criminal Law in Kentucky

Deferred Prosecution

I was accused of Harrassment in an altercation with a student. The school punished me but I retained my job. I went to trial that resulted in a hung jury and have since been offered a deferred prosecution. Where can I find information on exactly what a deferred prosecution is? I know what it is but am looking for details in Kentucky State Law.

Re: Deferred Prosecution

This may be sort of a "good behavior" bond in that if there are no further occurences for a period of time (up to 24 months in district court) then the prosecution would recommend dismissal. Check with your attorney to make sure. You will not find it in a KY statute. A prosecutor has broad descretion to go forward with a matter or dismiss it. This is the type of case where this is done. Usually the "victim" (complaining party) agrees to this. but, again, talk this over with your (I hope you have one) attorney.
