Legal Question in Criminal Law in Kentucky

Domestic/Sexual Assault

I was sexually assaulted in Ky by my ex-husband. police arrived, took a report and I returned home to TN. I was unable to obtain a warrant for him or an emergency protective order. Ky says I can't get one because I live in TN. TN says I can't get one because it didn't happen in TN. What can I do to protect myself and my two young children. I am in fear of my life and have no one who will help me in any way.

Re: Domestic/Sexual Assault

If you cannot get an Emergency Protective Order, then you can certainly seek a warrant. I do not know the circumstances of the event and cannot comment on whether or not the facts will support a criminal charge. Contact the County Attorney in the County where the incident occurred. Where you live does not matter however, you will have to be available as a witness when needed.
