drug trafficking

My son was in a house that the owner was selling Oxycontin, the police raided the house when he wasn't there. He has never sold anything to anyone. The dective told me that they came to the house to do a buy and my son was sitting there snorting vicoden, and offered to sell them some. This never happened. The detective told me they were mailing charges to him. Can they do this? He wants to take a drug test somehow to prove he doesn't do drugs. Would this be admissable in court?

If your son is about to be charged(although the detective may be blowin' smoke regarding the mailing of charges) as you've described, he should retain the services of a competent criminal defense counsel to represent him and to advise him and answer the many questions which both you and he may have regarding the case. In the meantime, your son should not be talking with the cops or to anyone else concerning the incident.

(The drug test which you've mentioned would likely have litle probative value in your son's case, and therefore would not likely be worth doing now as an after the fact analysis of what may have been in his system on the day he allegedly encountered the detective at the drug house.)
