Legal Question in Criminal Law in Kentucky

Expungement of Criminal Records

i would like to have a couple things expunged if i can. I have one harrassment and one obsolete violation of a protective order. These are bogus charges from my ex-wife in order to leave a paper trail so i could not get custody of my kids. I DID HOWEVER GET CUSTODY OF BOTH CHILDREN and have been a single father since they were 3 and 5 yrs old. They are 12 and 14 now. I cant get a better job and cant get even a descent part time job due to my background checks. I passed all meetings and tests for a job at toyota and all they had left was a background check and i was hired, they refused me because of the background check. I just want to be able to get a better job. These charges were 8 to 10 yrs ago. Can you help?....Thank You

Re: Expungement of Criminal Records

In KY, you can expunge misdemeanors after 5 years, or if the charges were "diverted", 60 days after the end of diversion. The violation of the DVO might be tougher, as they are considered civil in nature, and not necessarily subject to expungment. You'd have to file a motion and argue it before the court. Either way, my office can handle both for you if you like. Feel free to call. 859-491-5800
