Expungment

Hi! I worked in the state of Ohio as a transit bus driver for nearly 20 years. During that period I was convicted of non-flagrant support in Kentucky. Facing 1 to 5 years I wind up getting 5 years probation plus rearages. This happened in 1994. I never really worried about it for I was stable on my job. Now I am doing a career change. I want to be a truck driver. The company I want to persue told me that they couldn't hire me because I have a felony and the jog required that I drive through Canada. I went to Kenton County to fill out the paper work and the $100 fee also I went to Frankfort, KY to get a criminal background check. A week later I recieved a check for my $100 and a letter stateing that there is no legal authority that exists that can expunge the conviction. Is that true or do I need a lawyer or what can I do? I am still young and want to persue a new career. I just want to know what can be done to where no outside agencies have access to that information. I want to be able to put no felony on my application. I would very well appreaciate your reply.

In KY, you cannot, at this time, have a felony conviction expunged. It was proposed legislation last session, but failed. In a few years, hopefully, it should be new law, but as of now, you cannot. Sorry.
