Legal Question in Criminal Law in Kentucky
I filed a police report as being the victim of an assault. I did not make the call to the campus police but rather a concerned roomate. I was very drunk and don't remember how I got back to my room but I know I walked I also had a huge bruise on my cheek resulting in a black eye. The police came and I gave them a very vague report of being hit by a faceless person on my way back to campus to which I had no proof but was my assumption. I had told them I thought it happend in a certain area on campus which I don't remember walking through. They assumed I had picked a fight somewhere and gotten into a row there which was not the case as they drove the 2 blocks over and asked the owner of the house at which I was staying. I went back to my room and fell asleep, only to wake up an hour later from a police officer at my door. He then informed me that they never saw me on the security cameras overlooking where I had reported being. He then accused me of tearing down a tree branch near the area which I know I did not do as it was atleast 10 feet off the ground. I then asked how I could have done that if I wasn't even in the area. He became quite irritated and started to tell me that if I was lying and they continued to waste time on this that I could be looking at jail time and would be in very big trouble. I began to feel intimidated and told him that I was indeed lying and that I must have just walked into a door or fallen and injured myself, which indeed could have been the result of my wounded face. He turned and told me to not bother going to sleep he would be back. This was 2 days ago and I have not heard word from the Police station. They have my room address as well as my home address and my cell phone number. Should I consider contacting a lawyer or am I in the clear?
1 Answer from Attorneys
You don't need an attorney until charges are actually brought, but just remember, don't make any (further) statements to the police without an attorney present. None. Not a word. Whenever you are questioned by the police you say nothing except, "I'm not answering your questions. I want my lawyer." Amazing how much this is publicized on television crime and legal dramas, and yet, people still just keep blathering on to the police.
