Legal Question in Criminal Law in Kentucky

I formally owned a Cemetery in Bowling Green , Kentucky. I sold headstones to 4 people after I left the Cemetery.

I have been charged in the State of Kentucky with theft by deception (KRS 514.040) for stealing money for the headstones.

I have produced and installed 3 out of the 4 headstones and have the other one but the family purchased another one in the meantime so I have that headstone on my property.

I think this would fall under Consumer Law.

I believe this case should be civil and not criminal but I can't find any cases to support my Motion to Dismiss.

I would appreciate it if you could cite cases which pertain to my set of circumstances.
