Legal Question in Criminal Law in Kentucky
I formally owned a Cemetery in Bowling Green , Kentucky. I sold headstones to 4 people after I left the Cemetery.
I have been charged in the State of Kentucky with theft by deception (KRS 514.040) for stealing money for the headstones.
I have produced and installed 3 out of the 4 headstones and have the other one but the family purchased another one in the meantime so I have that headstone on my property.
I think this would fall under Consumer Law.
I believe this case should be civil and not criminal but I can't find any cases to support my Motion to Dismiss.
I would appreciate it if you could cite cases which pertain to my set of circumstances.
Thank you,
Eileen Santangelo

I would recommend you retain a criminal defense attorney to do that for you. This is a general advice site, not a free legal research site. And I suggest you not detail the facts of your case, with your name, on the internet, which is admissible in court and could be used against you.
