Legal Question in Criminal Law in Kentucky

ok my s/o is in jail, awaiting trial. His private attorney has been trying to get him on docket to be heard in circut court for release/bond reduction. HOWEVER last week the prosecuting attny indicated to our attny that they would look into the case and get back with him...they never did. And this week our attny tried to get a motion on the docket and here is his reply.

"I requested to proceed by information on the case at the time it was waived up to circut court. The Commonwealth attnys office however proceeded by regular grand jury they have acknowledged this was their mistake. the case was presented last Friday and the indictment will be returned this Friday. that is why the notice of arraignment & bond motion were returned.

What does this mean? that we cannot try to get him released?
