Without knowing the nature of the assault, i.e., degree, your question is difficult to answer. A fourth degree assault is a misdemeanor; 2nd degree is a class C felony and and 1st degree is a Class B felony. Assault of a police oficer is a Class D felony. The range of punishments is from 12 months to 20 years. You could be charged with assault in the first degree if a deadly weapon was used or a serious physical injury resulted to the polcie offcier.
Re: Maximum jail time associated with assaulting a police officer
You do not give enough information for an informative answer. The information is contained in Kentucky Revised Statutes (KRS) chapter 508. The severity of the charge under the statute dealing with assualts is determined by the severity of injury however. 1st degree assault is a class "B" felony carrying a potential penalty of 10 to 20 years. 2nd degree assault is a class "C" felony with a penalty range of 5 to 10 years; 3rd degree carries a penalty from 1 to 5 years and 4th degree carries a penalty of up to 12 months and/or fine of $500.00. An assault on a police officer is always a 3rd degree assault. There are also provisions providing for penalty enhancement when a family member is involved. Without more information, I am unable to give you any better answer.
