Legal Question in Criminal Law in Kentucky
Nude Internet Pictures
Is it illegal for people to send nude pictures of each other back and forth over the Internet? It seems to me it should be illegal since I view it as pornography.
Thank you for your help.

Re: Nude Internet Pictures
The short answer to your question is that pornography is not illegal, and is protected by the first amendment to the U.S. constitution.
Electronic transfer of obscene materials is illegal under federal and state laws, but numerous Supreme Court decisions defining obscenity have so limited the scope of anti-obscenity laws as to make them virtually unenforceable.
Nude photographs of children under the age of 18,
however, are strictly illegal under state and federal laws, and possession or exchange of this type of pornography is severely punished.
