Selling alcohol to a minor

My stepson is 41 years old. He is disabled and works part time at a liquor store in Kentucky and hasn't been in trouble with the law before. He was busy one night and didn't check the ID of a young person who came in to buy liquor. It turns out she was a decoy for the police dept. He got a citation to go to court, and I was wondering what could happen to him because of this?

I am a former prosecutor, turned defense attorney in Henderson County so I have a lot of experience wth this type of case.

The maximum penalty for a class B misdemeaner is 90 days in the county jail. In Henderson County, the standard offer for a first offense is ususally 3-7 days in jail with the balance of 90 days probated depending on the specific facts.

You will likely want to hire an attorney that can explain the disability to the prosecutor in an attempt to avoid incarceration.
