Legal Question in Criminal Law in Kentucky

Sexual Abuse

When I was 6 years old I was Sexual Abused by my father and my stepFather; we went to count but it was dismissed because I wouldn't tell my side of what happen, i was scared that they would hurt me. I'm 25 now, married and trying to put my past behind me. But my ? is: Do they have the right to see or be around my children? I no longer have anything to do with them, but i'm scared that my real father has rights to see my children, I dont want my children around my father or stepfather. Please help!! Do they have rights as grandparents?

Re: Sexual Abuse

Grandparents really do not have "rights" to visit grandchildren over the reasonable objections of the parents. They do have the right to ask the court to set visitation but the court must find that it is in the best interest of the children and that there has to be a reason to go against the parent's wishes. A lot goes into making this decision but the foundation begins with the court reviewing how much the grandparents have been in the children's lives, etc. If they attempt to see the children against your wishes or try to go to court to obtain these rights, seek the advise of an attorney. I don't think that they want you to say in court why you do not want the children to visit with them.
