Legal Question in Criminal Law in Kentucky

Tbut 300 dollars

In 1999 I was originally charged w/ tbut over 300 and tbut under 300. tbut over 300 was dismissed but i plead guilty to tbut under 300. all this time i thought i had a felony on my record. do i have a felony or not and if only a misdemeanor will it be taken off my record?

TBUT under 300 is a misdemeanor. So, if you plead to that, it's a misdemeanor. There is a process to expunge the conviction, but it's very specific. You should have an attorney review your status to determine if you are eligible for an expungement.

You have a felony arrest record, but only a misdemeanor conviction record.

There are several Kentucky laws which may apply to your situation:

KRS 510.300 Expungement of Criminal record.

KRS 431.078 Expungement of misdemeanor and violation conviction records.

KRS 431.076 Expungement of criminal records for those found not guilty of crimes

KRS 313.600 Request to expunge minor violations from permanent record --

KRS 311.275 Request to expunge minor violations from permanent record --

KRS 17.142 Segregation of criminal records.
