Theft By Unlawful Yaking, Unawful Transaction With A Minor
A month ago my 14 year old son and I were shopping in a department store and were caught shoplifting. He had 209.00 and I had 436.00. It was a stupid mistake on both our parts. This is the first offense of anything for both of us. Is there any wau I can get out of jail time or will I have to do time? I don't go to court for a little while yet and really don't know what to expect. Please tell me what I could be looking at. Many thanks

Normally, jail time is not imposed for a first offense when that offense does not involve violence or drugs. It varies from county to county in Kentucky, because of differences between prosecutors, but you (the adult) might have to plead to a misdemeanor (reduced from a felony) or could possibly participate in a pre-trial diversion program. The juvenile will be dealt will in juvenile court and could have to do some community service or something similar. A lawyer from your community would be able to tell you about the specific practices in your jurisdiction.
