Kentucky is only one of five remaining states which prohibits selling event tickets for a price higher than face value. (Buying a ticket for higher than face value is not illegal.) The crime is a misdemeanor, punishable by a fine up to $250.

It is technically illegal to scalp tickets over the telephone or the internet, or by mail, but since you cannot be extradited from one state to another for any crime less than a felony, the anti-scalping law is impossible to enforce unless you are physically present in Kentucky.

Every year, at the Kentucky Derby and various NCAA basketball games, persons are charged with ticket scalping by local police officials. Violators are usually hit with a small fine, but their tickets and money are confiscated, making this an expensive cost of doing business in Kentucky.
