Legal Question in DUI Law in Kentucky

alcohol intoxication

I was arrested for alcohol intoxication after the police knocked on my door and asked me to step outside. I was having a small party, the cops told me to make people leave, by driving home. I told the cops that I didn't want my guests to be driving while intoxicated and that they were staying the night. The officer then said that I was being disorderly and arrested me for alcohol intoxication. The officer never read me my rights and never gave me a breath-a-lizer, or any sort of soberity tests. My question is: Was I in violation of alcohol intoxication, and what approaches do I have in court to clear this off my record?

Re: alcohol intoxication

It certainly appears like you have a defense to this charge. I would fight it through trial, as there are several tactics i can think of that i would use. Feel free to call me at the number listed in my profile if you have questions. Good Luck
