DUI with permit only

Have license now go 2 court 5/30,first offence,bal .128,failed feild test, any jail time?Never been in trouble 32 years old.

DUI PENALTIES in Kentucky:

First Offense Within A Five-Year Period

MINIMUM FINE= $200

MAXIMUM FINE= $500

MANDATORY JAIL TIME= Minimum 48 hours, Maximum 30 days

DRIVER�S LICENSE= Automatically suspended for 90 days. Restricted hardship license may be issued after first 30 days.

TREATMENT= Mandatory 90-day alcohol education program (AEP).

Second Offense Within A Five-Year Period

MINIMUM FINE= $350

MAXIMUM FINE= $500

MANDATORY JAIL TIME= 7 days Minimum, 6 months Maximum.

DRIVER�S LICENSE= Automatically suspended for one year. No hardship license.

TREATMENT= Mandatory one year alcohol education program (AEP).

Third Offense Within A Five-Year Period

MINIMUM FINE= $500

MAXIMUM FINE= $1,000

MANDATORY JAIL TIME= 30 days Minimum, 12 months Maximum.

DRIVER�S LICENSE= Automatically suspended for two years. No hardship license.

TREATMENT= Mandatory one year alcohol education program (AEP).

Fourth Offense Within A Five-Year Period

MAXIMUM FINE= $5,000

IMPRISONMENT= Minimum of 1 year in penitentiary, maximum of 5 years. FOURTH OFFENSE D.U.I. IS A FELONY IN KENTUCKY. CONVICTION WILL RESULT IN LOSS OF CIVILRIGHTS, INCLUDING RIGHT TO VOTE AND RIGHT TO OWN OR USE ANY FIREARMS.

DRIVER�S LICENSE= Automatically suspended for two years. No hardship license.

DUI LAW (MISCELLANEOUS)

- Prior DUI offenses include all convictions in Kentucky and any other state. Also includes other jurisdictions such as Federal and military entities.

- No person is eligible for license reinstatement until the alcohol or substance abuse program has been completed.

- Defendant pays for mandatory assessment and education, alcohol or substance abuse program fees. A $200 service fee is also charged to defendants.

- License is surrendered to the Court.

- Defendant is also responsible for his attorney�s fee, license reinstatement fee ($40) and $69.50 court costs.

- Hardship license may be obtained for the final 60 days of the first license suspension ($5.00).

- Any person arrested for DUI and who, upon BAC testing, shows a BAC reading above .15 percent will be detained in custody at least four hours following arrest.

- $10.00 crime victim compensation fee added to all fines.

- If you are under 21 and convicted of driving with a .02 - .09 BAC, you will lose your license for a period of 30 days to six months. You may be fined and ordered to complete at least 20 hours of community service.

It's impossible to say what would happend to you if you plead guilty without an attorney.
