Legal Question in Education Law in Kentucky
I believe that my daughter had been treated unfairly by a middle school in KY.
My daughter has been making fun by other kids about her race and being liked by other boy at cafeteria . She was pinched by one of kids who discriminated her race and was suffered from the injury. She left out talked aloud to stop them and yelped by hurting from pinch. Unfortunately the principle of school chosen to not to believe her claim, and forced her to admit that she told a lie about someone pinched her, when really, a girl did pinch her badly. The spot where the other gilr had pinched my daughter, right above her wrist, really hurt, and it started to turn red.
My daughter has been an honor student for years and has never had any kind of problem at school at all. But Mrs Principle blame that my daughter ignored her when she called her at cafe but actually she didn't hear it at call. So Mrs Principle charged her a disruptive behavior at cafe and send her to SAFE for 1.5 days.
What the school has done could be acceptable, if they apply the same standards equally to all students. But they do not, I feel that they are being discriminatory based on our race by school administrator because my daughter has been treated differently than other. The injury on my duaghter's wrist and the racial harassment by other kids have never been addressed.
I am not sure if it could be a discrimination and racial harassment case? I am seeking a further legal assistant.
Thank you!
