My son has power of attorney for an elderly aunt. He has recently learned that her favorite niece who has a drug problem has forged about $3000 in check on the aunt's account, but she does not wish to prosecute. Can he prosecute without her concent?

That would be up to the Commonwealth's Attorney. A crime has been committed, but if the victim isn't going to cooperate, there isn't much to be done. Might be able to get her on drug possession at least.
