Legal Question in Family Law in Kentucky

My 4 year old son passed away on June 3rd. The coroner ruled it an accidental death. There were no signs of neglect or anything. Two days later CPS placed my other child in my grandparents care. We each have a case plan but they do not match. Mine says that my son remains in my grandmother's care pending the investigation and my grandmother's says it's for 30 days. The 30 days is almost up and neither I nor my grandmother have heard from a worker since day one. I don't even understand why they are doing an investigation. All the worker told me was that it was routine. We have tried non stop to get a hold of the worker with no luck. I just want my son back home. What can I do?

I'm so sorry to hear this terrible news. The best thing for you to do may be to retain an attorney if your goal is to put pressure on CPS. However, I suggest you stick with your case plan (not the grandmother's) and keep the child with her until the investigation concludes. You may continue to contact CPS and send letters in hopes that it will move things along but that may not work. I suggest you record any conversations with CPS.

If any allegation is "substantiated" against you then I recommend you speak with an attorney immediately after you received notification of this allegation so the attorney may discuss your rights to and administration hearing (notice for such a hearing request must be submitted within 30 days of a substantiation decision).
