Legal Question in Family Law in Kentucky

My 3 yr old granddaughter was placed with a permanent custodian (maternal aunt) in October 2009. The parents were never married and mother has terminated rights. My son is trying for custody (but has a felony dui). Can I, as a grandmother petition for custody?
