my boyfriend has custody of his grandson and we want to adopt him do we need to get married or can we have my name on the papers as we are

First, if the parent or parents are still living, then they would either need to consent to an adoption or have their parental rights terminated involuntarily. This can be complicated.

If the parental rights are terminated or they consent to the adoption, and you both want to adopt, then it would be simplest if you and your boyfriend were married.

Under Kentucky law, you and your boyfriend would have to be married to adopt the child. Additionally, a court would have to terminate the parental rights of the child's mother and father.
