Legal Question in Family Law in Kentucky

adoption re:back child support

I am in the process of allowing my ex-girlfriend's husband of 8 years to adopt my daughter, age 9, whom i've been paying child support for, since birth, but have never seen. I realize that after the adoption is final, I will no longer have to pay child support. will the $6,000. in arrears be disolved automatically, as does the current? It is not owed to the government but to my ex. If she chooses to not make me pay the arrears to her,(cause she wants me out of the child's life completely.) will the Social Service's still make me pay it back? even though it is not owed to them. can i refuse to sign the adoption papers if she don't waive the arrears? can the adoption be finalized without my signature? since she had my daughter's last name changed via the courts, to her step-father's name without my permission or even notifying me of the action 5 years ago. Please shed some light on this confusing matter. Thank you.

The arrearage will not automatically dissolve. Social Services will not make you pay unless she demands it. You can refuse to sign the adoption papers for any reason you choose. The adoption cannot be finalized without your signature.

Along the same lines as Mr. Harding's advice, I would advise you to make your signing of the adoption papers contingent upon her agreement to forego the arrearage. And get it in writing! Consult an attorney in your area that can draft the proper agreed orders. Good luck. Feel free to call if you have questions.
