Age of majority

My niece, who lives in Kentucky, Wants to move to California to live with me. She is having some problems at home. She is 17 but turns 18 in 2 months. Can she legally leave home now or does she have to wait the 2 months untill she is 18?

With the parents consent, she can be "contractually emancipated". This is not quite as good as obtaining guardianship, but with the time factor it may be the only viable one. Without parental consent or proof that living with her parents endangers her well-being, there is nothing to be done.

She can legally leave home when she is 2 years old if the parents consent. If the parents do not consent, then you would have to get a temp guardianship in the state where the child resides. Once the child turns 18, the guardianship is moot and the child can live where she chooses, so long as she has permission to stay there.
