I would like to know how I can be divorced in the State of Ky w/o ever having agreed to the ''bifurcated proceedings'' that the judge granted to my husband, the one actually contesting the divorce. This decision has put me in a very precarious financial situation as husband is still in control of all assets since divorce granted in May 2001. Is it legal? Can I contest it? Do I have any rights?
Details:
1. 15 1/2 year marriage, wife asking for maintenance due to length of marriage & disparity in income.
2. Wife began divorce proceedings in Oct 2000, husband contests due to maintenance..no settlement agreement. Husband in marital home with all marital property.
3. Trial date set for May '01..husband files motion in April '01 for bifurcated proceedings..judge grants.
4. Judge issues divorce May 7, '01..judge postpones trial on date of trial May 21, '01.
5. Oct '01..Judge will not issue new trial date due to the fact that he was leaving his position.
6. November '01..New judge...trial set for January '02.
