My ex-husband and I divorced in 1992. Our child was 2 years old. Our child custody is as follows...3 1/2 days each week with each parent. Child support in the amount of 240.00 a month and he claims the child as a dependant on his taxes EVERY year. In 1995, my child started school, and lived with me, spending weekends with his father. Starting 2 years ago, he started only going to his father's house every other weekend, and sometimes not even that. My son is 12 years now, I still recieve 240.00 a month, my ex still claims him every year on his taxes and now recieves the the child credit of 600.00 also. Allowing him to earn 620.00 a year for being a father. I want to know if I ask for a modification of this order, what would be my chances of being able to claim my son on my taxes from this year till he is 18. Please advise

There should be no problem with this. You are entitled to the deductions and exemptions. You may even be entitled to change your filing status. Check not only with your attorney but your tax return preparer.
