Legal Question in Family Law in Kentucky

Child Custody

I share joint custody of my 3 year old daughter with her father. He is in Kentucky and that is where we were divorced. I have recently relocated temporarily for work to MD and before I left him and I had a verbal agreement to share custoday a month at a time back and forth. He has been cooperating for over 3 months now after our agreement and now he doesnt want her to ever come back to Maryland again with me. I don't want to be without her for 6 more months while I'm here, have I lost all of my rights as her mother from joint custody because I moved? Is our verbal agreement not binding even though he has been following it until now?

Re: Child Custody

You have not lost your rights but it is imperative that you get a motion filed right away in Kentucky to address this issue. The court is not required to follow the verbal agreement. They will look at best interest of the child and the longer you let this go without filing something in court the more the court will tend towards leaving her with the father.
