Kentucky law creates a presumption that each parent has equal custody rights to the child. When this is disputed, courts use several factors to determine the custody and time-sharing between the parents. That's all I can really say without knowing more about the situation except that if the child has been with you through the separation, then that is a factor that weighs in your favor.
