Legal Question in Family Law in Kentucky

Child Support

My divorce decree says that to modify my support, that it may be modified by court upon the request by the petitioner(my ex husband). Does this mean i cannot request an increase? Unless he does?

Re: Child Support

That phrase is pretty meaningless and was probably stuck in the decree as a routine clause or to appease your husband into feeling like he had more control than he really had. Who knows for sure.

Under Kentucky statue, either party can move the court to modify child support (I am assuming this is about child support and not maintenance/alimony). There is a presumption to modify when there is a change in either parties income that would cause a 15% increase or decrease in the support amount.
