Child Support

If my 18 old legal changes her last name to her step father's name, do I still have to pay support?

First, you need to file a motion in order for anything to happen. Why I can't think of any law off the top of my head to support your argument, I think it would be a good one. However, I would like to go to court with more than just that. I suggest you consult with an attorney.

Just the fact of a name change would not appear to eliminate a parent's duty of support. There is a NJ Supreme Court case that indicates that the custodial parent may determine the child's name but there are exceptions. There are questions about whether the step parent has held the child as his own and has stood in the place of parent. You may need to explore whether the child may soon be emancipated and that would relieve you of paying support. Please contact me or email more details for me to evaluate your position. If the step parent adopts the child that would probably eliminate future support as well.
