Child support responsibilities

If a married woman has a child by another man, what rights does the biological father have as far as child supoort, health care prior to the court case?

Hello --

A child born during marriage is legally presumed to be the child of the husband. Paternity must be proven by clear and convincing evidence (i.e. DNA testing) before the law would really recognize rights and responsibilities of the biological father. Once paternity is proven, the biological father would have support obligations, health care provision obligations, and the benefits of visitation, etc. At that point, the biological father could also seek conservatorship of the child, if desired.

i would concur with the reply submitted by mr. winters as concerns the law in kentucky. i would add that unless and until a paternity action is begun against the mother in kentucky, the biological father has no rights. any paternity action most likely have to be brought in which the state the mother and child reside.
