Child Support Violation

My fiance has been arrested (09/19/03) for child support violation. He is in violation approximately $7000.00 to $8000.00. The state of Kentucky is currently auditing his arrearages. How are they able to issue a warrant for his arrest without knowing the amount to which they are owed?There is an extradition hearing on Monday 09/22/03. What do I have to do to keep him from being extradited to Kentucky? How do I find him representation immediately? What is the cost of this type of representation?

The best way to keep your fiancee in this state is to contest the extradition at the hearing. There are procedures for this that arre quite involved and depend heavily upon the facts in the case. It is important that he not sign a waiver of extradition to Kentucky. The state's attorney (prosecutor) may attempt to procure one from him. It is important that he not sign anything without consultation with an attorney.

Extradition matters are intricate. It would appear that there is a contempt of court matter pending in Kentucky and it is on that basis the Kentucky court may have issued the warrant. There would not need to be a specific total involved, but rather only a finding that there is a court order that your finacee has not followed. The court here in Illinois may issue a bond while your fiancee contests the extradition. It is important that he have counsel on Monday.
