Child support/custody?

My girlfriend and I (never married) had a daughter together in Massachusetts in 2006. I was born and raised in KY and the 3 of us moved down here to KY in 2007. My daughter, girlfriend, and I have lived together since her birth 2.5 years ago. I own the house and we have an agreement that I pay the mortgage, taxes, insurance, and bills and she pays for the childcare and diapers. I work full-time plus some and she works 40 hours per week as well. My girlfriend and I want to break up. I want her to move out the house and she is willing to move if/when she finds a place. However, she keeps threatening me that I'll only see my daughter on weekends and I'll have to pay child support, etc. Is it possible for a break-up that consists of sharing equal time with our daughter (3.5 days per week), splitting our daughters cost right down the middle (child care, clothes, diapers, etc). This is what I want, but she keeps saying 'you'll have to pay me child support and you'll never see your daughter.' As long as both of us are working, and willing/able parents that love our daughter, wouldn't the courts allow us to see her equal amounts of time and split costs equally? Again, we were never married...

This is a matter in which a Petition for Custody would need to be filed. If you are able to work out a settlement, then anything is possible, as long as it's agreed. Otherwise, it may be a situation where you end up in Court arguing over child support and visitation. There are many issues on the table in your matter and if you intend to go forward with the split, then best case scenario is to contact an attorney and discuss filing a Petition on your behalf.
