children taken out of home due to neglect

My cousin by marriage has two children that were taken out of the home due to neglect and placed with their maturnal grandma. Her rights to them were terminated due to this fact. My question is, she is now preg. again and due in three weeks. She has been incarsuated and will not be out for a while. I want this baby. If her rights were terminated with the other two, is it the same for this one? Can the courts terminate her rights for this baby?

I can only give a "most likely" answer. One of the statutory factors to consider in terminating parental rights is if rights to another child by the same parent was terminated prior to this ones birth. So, most likely the Cabinet will take custody of this child and will most likely pursue either permanent relative custody or termination or parental rights.
